Welcome to the website of Infinite Future Tennis (“Club,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and online booking services (collectively, the “Services”), as well as your participation in our court rentals, lessons, clinics, matchplay, and programs (“Activity,” or collectively, “Activities”).

By accessing our Services or booking an Activity, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Eligibility and Account Registration

  • Age Requirement: You must be at least 18 years old to create an account and book Activities. Parents or legal guardians must create accounts and book on behalf of minors.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

2. Court Rentals, Lessons, and Program Bookings

  • Booking Policy: All court rentals, private/group lessons, and program registrations must be booked and paid for in advance through our online platform or front desk.
  • Guest Policy: Members booking a court are responsible for registering their guests and ensuring guest fees (if applicable) are paid prior to play.
  • Club Rules: All players must wear non-marking tennis shoes and appropriate athletic attire. The Club reserves the right to remove any individual violating safety or conduct rules without a refund.

3. Cancellation, Rescheduling, and Refund Policies

  • Court Rentals & Private Lessons: Cancellations or rescheduling requests must be made at least 24 hours prior to the reserved time. Cancellations made with less than 24 hours’ notice will forfeit the full booking/lesson fee.
  • Clinics and Seasonal Programs: Registration for multi-week programs is non-refundable once the session begins. If the Club must cancel a session due to weather or scheduling conflicts, a club credit or make-up class will be issued.
  • Inclement Weather (For Outdoor Courts) and Force Majeure: The Club will determine court playability and facility usability. If courts or facilities are closed due to weather, you will receive a full credit or refund for the affected booking.

4. Fees, Billing, and New Jersey State Sales Tax

  • Pricing: All prices for rentals, lessons, and programs are posted on our website and are subject to change.
  • Taxes: In accordance with New Jersey state law, certain club memberships, admissions, or amusement charges may be subject to 6.625% NJ Sales Tax, which will be calculated and added at checkout where applicable.
  • Payment Authorization: By providing a payment method, you authorize us to charge the specified fees to your designated payment card. 
  • Payment Processing: The Club uses third-party payment processors (collectively, “Payment Processors”) to securely process your credit card and financial transactions. We do not store full credit card numbers or sensitive financial credentials on our servers. To the fullest extent permitted by law, the Club shall not be liable for any errors, security breaches, data leaks, or unauthorized charges resulting from the acts or omissions of our third-party Payment Processors. Your payment processing transactions are subject to the terms, conditions, and privacy policies of the applicable Payment Processor in addition to these Terms. 

5. Assumption of Risk and Liability Waiver

IMPORTANT: PLEASE READ CAREFULLY Tennis and related physical activities involve inherent risks of injury, including but not limited to sprains, fractures, heat stroke, and cardiovascular events.

  • Assumption of Risk: By utilizing the Club’s facilities, courts, and equipment, you voluntarily assume all risks associated with participation in tennis Activities.
  • Liability Release: To the fullest extent permitted under New Jersey law, you release, waive, and discharge Infinite Future Tennis LLC, its owners, employees, and independent contractors from any and all claims, demands, or liability for personal injury, property damage, or wrongful death arising out of your use of the facilities, except where caused by the Club’s gross negligence or willful misconduct.
  • Emergency Medical Treatment: In the event of an injury, accident, or medical emergency during your participation in any Activity or presence at the Club’s facilities, you hereby authorize Infinite Future Tennis LLC, its staff, and agents to seek or administer emergency medical treatment, including but not limited to calling emergency services (911), arranging transportation to a medical facility, or administering basic first aid. You explicitly agree that:
    • (a) You, or your parent/legal guardian if you are a minor, assume sole financial responsibility for all costs, fees, and expenses incurred for such medical treatment or transportation (including ambulance fees).
    • (b) The authorization granted under this section does not impose a legal duty or obligation upon the Club to monitor or administer medical care.
    • (c) To the fullest extent permitted under New Jersey law, you release and hold harmless the Club from any claims arising out of the administration or seeking of such emergency medical care.

6. Intellectual Property & User Conduct

  • Website Content: All text, graphics, logos, images, and software on our website are the property of the Club and protected by copyright laws. You may not reproduce or distribute this content without permission.
  • Prohibited Behavior: You agree not to use the website or booking system to disrupt operations, harvest user data, or attempt unauthorized access to our servers.
  • Privacy Policy: Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection practices. 

7. Governing Law and Jurisdiction

These Terms and any disputes arising out of your use of the Services or Activities shall be governed by, construed, and enforced in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any legal action must be filed in the state or federal courts located in New Jersey.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website or via email. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
